The 46-year-old Moradabad businessman, who had accused his co-passengers travelling by Padmavat Express on January 12 of “pulling his beard, beating him with the belt, forcing him to chant religious slogans and taking away Rs 2,200”, was on Tuesday arrested by the Government Railway Police for allegedly molesting a 20-year-old woman, said GRP sources.

The accused was arrested in Moradabad shortly after the woman, a resident of Shahjahanpur district, recorded her statement before a Railway Magistrate under Cr.PC section 164, accusing Asim Hussain of molesting her when she was travelling in the same coach of Padmavat Express in which he was on January 12, said sources. The woman further alleged that as she started crying while resisting his molestation bid, her co-passengers got angry and beat him up.

Based on her statement, a case was registered against Hussain under section 354 (assault or criminal force to woman with intent to outrage her modesty) of the Indian Penal Code (IPC) at the GRP, Moradabad police station, they said. GRP officers later produced Hussain before the Railway Magistrate and he was sent to 14-day judicial custody.

Moradabad (GRP) SP Aparna Gupta said, “We have been saying since January 12 that the charges levelled by the businessman were false. It took us four days to trace the woman after identifying her from CCTV footage. The accused was sent to jail.”

Following Hussain’s complaint, an FIR was registered on January 13 under IPC sections 323(voluntarily causing hurt), 504 (intentional insult with intent to provoke breach of peace), 392 (robbery), 506 (criminal intimidation) and 298 (uttering words etc with deliberate intent to wound the religious feelings of any person), said the SP.

Satish Kumar (23) of Rae Barely and Suraj Kumar (25) of Pratapgarh were arrested on the charges of breach of peace but both were released on bail, added the SP.
