The Basti district court issued fresh orders to the Gorakhpur Chief Medical Officer (CMO) to submit a medical report of murder convict former minister Amarmani Tripathi after a board of doctors formed for the purpose failed to file any report on Monday.
The state government had on August 24 ordered the premature release of Tripathi, the former four-time MLA who undergoing treatment at the BRD Medical College in Gorakhpur, and his wife since they were serving life imprisonment in the 2003 murder case of poetess Madhumita Shukla.
The court is hearing a 2001 case of the kidnapping of a local businessman’s son in which Amarmani, who was then an MLA, is the prime accused.
Basti special public prosecutor Devanand Singh said, “The court had earlier sent notices to the Basti district police to ensure the presence of Amarmani in the case. The police had filed a report stating that Amarmani is undergoing treatment at BRD Medical College in Gorakhpur. On August 14, the court directed the Gorakhpur CMO to constitute a medical board to examine Amarmani’s health condition and submit a report on the next date of hearing (August 28).”
“Today, when Amarmani’s medical report was not filed, the court issued fresh orders directing the CMO to constitute a medical board and submit the report by the next date of hearing on September 15. The court had also ordered to again issue a notice of attachment of property of two accused wanted in the case. The two accused Shivam, alias Ram Yagya and Naineesh Sharma had jumped the bail,” added Singh.
The Basti police had filed a report on the last hearing that efforts were being made to trace Shivam and Naneesh, the public prosecutor said. “The police claim to have visited the houses of both the absconding accused who could not be traced. The police also visited their possible hideout in Lucknow on a tip-off but to no avail,” he added.
Gorakhpur CMO Dr Ashutosh Kumar Dubey said the medical board has been formed and Tripathi’s health condition is being examined.
In 2001, Basti-based businessman Dharam Raj Gupta’s son Rahul Gupta was allegedly kidnapped from near his house. During the investigation, the police claimed to have recovered Rahul Gupta from a house with alleged links to Amarmani Tripathi.
The police had filed a case against nine persons, including Tripathi. One of the nine accused has died.
The file of five of the accused has been separated from others.
“The court is yet to frame charges in the case. One of the five accused recently moved a discharge application in the court, claiming he was falsely framed in the case. The court has not decided on the petition,” Singh said.
