12-yr-old booked for ‘breach of peace,court frowns

A 12-year-old boy has been slapped charges under Section 107/16 of the CrPC in Shahjahanpur district. The section invites police action against a person for anticipated “breach of peace”.

The boy,Sahdev,along with his father Bishen Singh,a farmer,appeared before the court of Sub-divisional Magistrate on Thursday. Bishen (45) informed the court the police had wrongly framed him and his son,who is a student of class VI,and requested it to look into the matter.

On his request,Sub-Divisional Magistrate DP Singh ordered an inquiry in the incident on Friday.

“I have directed the Circle Officer to conduct an inquiry and file the report,” said the SDM. He added that there was also a dispute over the name of the boy.

The court notice mentioned the name of Bishen’s son as Sahab Singh,18. “I told the court that my son’s name is Sahdev,” said Bishen.

A resident of Nagariya Prayagpur village,Bishen received the notice issued by the SDM court three days ago. The notice asked him and his son “Sahab Singh alias Baade,18”,to appear before the court.

According to Bishen,he had supported gram pradhan candidate Jaipal during 2010 panchayat elections. Over a dispute related to canvassing,a clash had taken place involving him and the supporters of Jaipal’s rival Ganga Ram. A non-cognizable report was filed against four persons including Bishen.

In November,the police slapped the charges under Section 107/16 of CrPC against Bishen and his son allegedly following pressure from some local politicians. The court issued a notice which was received by Bishen three days ago.
