Telangana human rights body flags Nizamabad hospital encounter, seeks ‘detailed factual report’ from DGP

The Telangana Human Rights Commission (TGHRC) on Tuesday took suo motu cognisance of an alleged encounter at Nizamabad Government General Hospital that led to the death of a vehicle theft offender, and directed Director General of Police (DGP) B Shivadhar Reddy “to submit a detailed factual report covering the circumstances leading to the incident”.

The incident took place on Monday when Shaik Riyaz was killed in an exchange of fire at the hospital when he tried to snatch a weapon from a police constable in his bid to escape, as per the police.

“The incident, as reported, involves custodial circumstances, and raises important questions relating to the right to life under Article 21 of the Constitution of India, as well as compliance with the guidelines issued by the Hon’ble Supreme Court in People’s Union for Civil Liberties v. State of Maharashtra (2014) 10 SCC 635 and NHRC Guidelines (2010, reaffirmed 2014) concerning encounter deaths,” the commission stated.

It further directed DGP Reddy “to submit a detailed factual report covering the circumstances leading to the incident, the status of any magisterial or judicial inquiry, and compliance with the Supreme Court and NHRC guidelines on encounter deaths, along with copies of the FIR and post-mortem report”. The report must reach the commission by November 24, it added.

According to police, Riyaz was an accused in the murder of Police Constable M Pramod Kumar, 42. On Monday, Riyaz allegedly attempted to escape after attacking police officers at the Nizamabad government hospital. “The police made strenuous efforts to apprehend Riyaz. He tried to snatch a weapon from the police and fire at the officers. In the attempt by the police to subdue Riyaz, he was killed,” a release from DGP Reddy had stated. “Today, he attempted to snatch a firearm from the police and fire at the officers while attempting to escape. In the ensuing shootout, Riyaz was killed,” the release added.

Further, the DGP stated that the government and police department would support Kumar’s wife, Praneetha, and their three sons. “We will support Pramod’s family by granting an ex-gratia of Rs 1 crore as per GO Rt No. 411, last paid salary till the retirement of the martyred constable, a government job for one of the family members, a 300-yard house as per GO155, as well as an ex-gratia of Rs 16 lakh from police security and Rs 8 lakh from police welfare,” the DGP stated.

Kumar was allegedly stabbed to death by Riyaz when he was escorting the latter to the police station on Friday night in connection with a bike theft case. Kumar was rushed to the Nizamabad Government General Hospital, but doctors pronounced him brought dead.
