Swati Maliwal assault case: Delhi Police to take Arvind Kejriwal aide Bibhav Kumar to Mumbai to recover phone data

The Delhi Police said Bibhav had formatted his phone after travelling to Mumbai before the arrest in the Swati Maliwal assault case.

The Delhi Police were set to take Chief Minister Arvind Kejriwal’s aide Bibhav Kumar to Mumbai on Tuesday to retrieve data from his formatted mobile phone. Kumar was arrested for allegedly assaulting Aam Aadmi Party (AAP) Rajya Sabha MP and former Delhi Commission for Women (DCW) chief Swati Maliwal.

Senior police officers said Bibhav had formatted his phone after travelling to Mumbai before the arrest. “He created a backup of all the deleted material from his phone and transferred it to another device which is in Mumbai. We have traced the device’s whereabouts and will recover it,” said an officer.

The police said Kumar’s phone is password protected, and “it was revealed that he had formatted the entire phone of all pictures, videos and any other material which can prove beneficial to our investigation after forensic experts took it”.

The Delhi Police have created a five-member special investigation team (SIT) to probe the Maliwal assault case. It is headed by Additional Deputy Commissioner of Police (North) Anjitha Chepyala.

Kumar was arrested on Saturday, two days after a case was registered against him for allegedly assaulting Maliwal inside the chief minister’s house in Civil Lines when she purportedly came to meet Kejriwal as part of an appointment on May 13.

Kumar was booked under sections 308 (attempt to commit culpable homicide), 341 (wrongful restraint), 354 (B) (assault or use of criminal force to a woman with intent to disrobe), 506 (criminal intimidation), and 509 (word, gesture, or act intended to insult the modesty of a woman) of the Indian Penal Code. The police later added IPC Section 201 (destruction of evidence) in the FIR against Kumar
