With infrastructure almost ready,family courts may soon become a reality in the Capital.
Constituted under the Family Courts Act,1984,these courts aim at taking family and marital disputes away from the overcrowded and intimidating traditional courts.
Around 10 rooms have been earmarked at the Dwarka district court complex for the purpose. Also,a notification has been issued to appoint counsellors for these special courts.
These family courts differ from conventional courts in their functioning. Family discords in these courts are resolved with the help of a judicial officer and an adequately qualified counsellor; the need of a lawyer can also be done way with.
The act prescribes for minimal technicalities in these courts and lays down procedures based on alternative resolution methods like mediation and conciliation.
According to the act,the atmosphere has to be kept congenial,sympathetic and supportive,for the goal of these courts is conciliation between estranged family members and not confrontation.
The Delhi High Court is also looking after other requirements,including appointment of judges,so that these courts become functional soon.
Such courts are already functioning in states like Maharashtra,Uttar Pradesh,Rajasthan,Tamil Nadu and Orissa.
