Delhi High Court grants 2-day custody parole to Engineer Rashid to attend Parliament

The Delhi High Court also imposed conditions that Abdul Rashid Sheikh, also known as Engineer Rashid, shall not use his phone or address the media.

The Delhi High Court Monday granted Jammu and Kashmir Independent MP Abdul Rashid Sheikh, who is accused in a terror funding case, two-days custody parole to attend the ongoing Parliament session.

Justice Vikas Mahajan granted Rashid, who is also known as Engineer Rashid, permission to attend the Parliament session on February 11 and 13 under custody parole, while imposing conditions that he shall not use his phone or address the media.

A detailed order is yet to be made public.

Rashid is in judicial custody in connection with a terror funding case being investigated by the National Investigation Agency (NIA).

Last Friday, the High Court reserved its order in the plea by the Baramulla Independent MP. Noting that the court has jurisdiction to exercise its discretion in such cases, relying on past judicial precedents, Justice Mahajan orally remarked to the National Investigation Agency (NIA) counsel Akshai Malik and senior advocate Siddharth Luthra that “there has to be material” to indicate that there might be a security concern or risk, to deny him custody parole.

Rashid was arrested in 2019 under the Unlawful Activities (Prevention) Act. According to NIA, he allegedly used various public platforms to “propagate the ideology of separatism and secessionism”, was closely associated with various terrorist organisations, and wanted to “legitimise” the United Jihad Council, a platform of anti-India militant groups in Jammu and Kashmir.

The first part of the Budget Session of Parliament ends on February 13.
