Lieutenant Governor Najeeb Jung has written to Justice S N Agarwal — who is heading the government-appointed commission of inquiry in the alleged CNG fitness scam — expressing his inability to ‘assist’ in the proceedings.
According to sources, this could lead to a fresh standoff between the Delhi government and the Lt Governor.
In his letter to Agarwal, Jung wrote that as the Ministry of Home Affairs (MHA) called the commission legally invalid and ‘ab initio’, he would not be able to assist in the inquiry.
“…MHA had declared it legally invalid. Therefore, I am constitutionally bound to follow the instructions of the MHA…,” stated the letter.

The government had countered the MHA and said the commission is legal as was constituted based on a decision by the cabinet. The matter is now in court, said a senior official.
Earlier, the government had constituted a commission of inquiry to look into allegations of corruption in awarding licence to conduct CNG fitness tests. The MHA had said the government was not a “competent authority” to constitute such commission.
The Lt Governor had then asked the Anti-Corruption Branch to look into the entire matter afresh.
