In a significant move, the Punjab Town and Country Planning Department has partially revoked the Change of Land Use (CLU) permission granted to Sunny Lovely Developers Pvt Ltd. The action follows a complaint alleging that the company submitted forged consent letters and a fake bank NOC for 9 kanals and 15 marlas of land in Daidi village, Mohali district.
The developer had originally been granted CLU permission in 2018 and 2019 to develop an industrial colony on 56.5375 acres of land spanning Daidi and Dhurali villages. However, in 2022, Surinder Kaur, wife of Hardayal Singh, lodged a complaint claiming that her share of land was fraudulently included in the project.
After scrutinising land records and bank reports, the government concluded that the documents submitted were indeed fabricated. Consequently, the CLU approval for 9 kanals and 15 marlas of land has been cancelled under Section 85 of the Punjab Regional and Town Planning and Development Act, 1995. A copy of this order is with The Indian Express.
The government has made it clear that the developer will not be entitled to any compensation, refund, or fee adjustment for the cancelled approval. Moreover, if any construction has been carried out on the disputed land, it will be the developer’s responsibility to either demolish it or compensate for the same. The company has also been directed to submit a revised layout plan that excludes the cancelled land.
Copies of the cancellation order have been forwarded to GMADA, PUDA, SSP Mohali, DC Mohali, and other authorities concerned for necessary action.
The government has clarified that in matters related to land ownership, financial transactions, or other disputes, both Sunny Lovely Developers and complainant Surinder Kaur are free to approach the courts.
