Produce Amritpal Singh, habeas corpus in Punjab and Haryana High Court

The Punjab and Haryana High Court bench of Justice NS Shekhawat has issued a notice to the State of Punjab and its police officials for March 21 on a habeas corpus petition seeking to produce Waris Punjab De chief, Amritpal Singh, before the court.

The petitioner, Imaan Singh Khara, the legal advisor of Waris Punjab De, alleged that Singh had been illegally detained by officials of the Punjab police.

The petitioner argued that Singh had been illegally and forcibly detained by Commissioner of Police, Jalandhar; Commissioner of Police, Amritsar; SSP Jalandhar; SSP Amritsar; SHO Model Police Station Shahkot; and SHO Police Station Ajnala. The petitioner requested the High Court to release Singh from their custody.

The petition alleged that on March 18, 2023, punjab police officials along with Central Para Military Forces, illegally and forcibly detained Singh without disclosing any reason for his detention. The petitioner contended that more than 24 hours had passed since the detention, and Singh had not been produced before any court of law, which was a violation of his fundamental right to liberty.

The petitioner further argued that the whereabouts of Singh were unknown, and despite approaching all concerned authorities for his release, he remained in custody.

The petitioner requested the High Court to direct the respondents to produce Singh before the court and to release him immediately.

The next hearing is scheduled for March 21.
