The Police Complaints Authority (PCA) has recommended suspension of UT Police Sub-Inspector (SI) Rajbir Singh,posted at the Sector 31 police station,for misusing his powers as a police officer. The complainant Munni Devi,a resident of Ram Darbar,had alleged that in August last year,her son Kailash was severely beaten by three brothers Satish,Sumit and Monu when he (Kailash) had gone to the market. His jaws and two teeth were broken and he was admitted to GMCH-32 by the cops.
Her grievance was that the police did not taken any action against the assailants. They did not register a case for 11 days despite the family being threatened of dire consequences. Munni Devi said she had visited the the police station and when she did not get a positive reply,she submitted a complaint at the police HQ public window.
She also met the DSP of the area,who forwarded her application to the Sector 31 police station SHO. But Investigating Officer (IO) SI Rajbir took three more days to register a case. As the IO did not take action,she submitted two more complaints at the public window as the accused kept visiting their house and threatening them.
She further stated in her complaint that her son Kailash could not bear the continued threats and police inaction and committed suicide by hanging himself from a ceiling fan inside their house on August 31. The police initiated proceedings under Section 174 CrPc as Kailash had not left a suicide note.
The complainant had alleged that she had lost her son due to the continued threats from the accused for over 20 days that his entire family would be eliminated. But SI Rajbir Singh denied all the allegations and claimed that the complainant had declined to give her statement,which had led to the delay.
The explanation put forward by SI Rajbir Singh is absolutely hollow and baseless. Munni Devi was running from pillar to post for action. Her son was admitted to hospital. It cannot be believed that she refused to give her statement to the police. She had met DSP B S Negi and sent a direct written complaint to the SSP. She had filed three reports at the window. It was SI Rajbir Singh who deliberately delayed action. The injured was taken to hospital by the police. The incident was,thus,within the knowledge of the police. Still,the FIR was recorded 11 days after the incident. The case was spoilt by delay and resulted in suicide by Kailash who perhaps ended his life due to the intense and unbearable pressure of threats on him and his family by the assailants. No inquiry was made into the cause of suicide, read the PCA order.
It is clear beyond doubt that SI Rajbir has acted in a grossly malafide and biased manner. He has not taken any action whatsoever in regard to the case of abetment of suicide. He deliberately and for apparent malafides delayed registration of the case. A precious life has been lost due to deliberate inaction against the assailants. SI Rajbir is ordered to be placed under suspension forthwith and to be proceeded against for disciplinary action through a departmental inquiry, the order further read.
