The state Anti-Terrorism Squad (ATS) on Saturday submitted before the additional sessions judge N P Dhote that there is no immediate prospect of arresting the six absconding accused in the German Bakery blast case and requested it to proceed with the trial against arrested suspect Himayat Inayat Mirza Baig of Beed as the case is now ripe for recording evidence of witnesses.
Detailing efforts to search for the absconding suspects,Assistant Commissioner of Police Vinod Satav,the investigating officer in the case,filed an affidavit under section 299 (recording of evidence in absence of accused) of CrPC stating he had obtained open non-bailable warrants against the six,Mohsin Ismail Choudhary,Ahmed Siddibappa Zarar,Riyaz Ismail Shabadri alias Riyaz Bhatkal,Iqbal Ismail Shabadri alias Iqbal Bhatkal,Fayyaz Kagzi alias Julfikar Fayyaz Ahmed and Sayyed Zabiuddin Sayyed Jakiuddin alias Zabi Ansari.
The affidavit states that since the warrants could not be executed,proclamation notices were issued in their names on June 22. Meanwhile,further to last date of hearing when ATS had filed an application to admit evidence of formal witnesses by way of affidavits,instead of calling them to depose,defense advocate A Rehman submitted his say requesting the court to drop such witnesses if they are of no use to either the prosecution or the defence.
Special Public Prosecutor Raja Thakare had stated that most of these witnesses comprise injured persons and claimants of bodies. The ATS has not given names of witnesses who intend to depose via affidavits, Rehman said. The court directed ATS to furnish their names. Rehman said he would like to examine doctors who prepared reports about shrapnel found in the blast injured.
He submitted an application stating he had seen CCTV footage at the ATS office on August 13. As reported earlier Rehman had submitted to court that Baig was not seen in the footage.
