The Himachal Pradesh High Court Thursday ordered the National Highways authority of India (NHAI) to suspend collection of user fee at the Sanwara Toll Plaza in Solan district on the Shimla-Kalka National Highway-5 from September 20 to October 30 citing poor road conditions and inadequate facilities.
A division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Ranjan Sharma issued the order while hearing a public interest litigation filed by Utansh Monga of Una district.
Advocate Ganesh Barowalia, representing Monga, said, “The court took strict note of the bad condition of the National Highway, particularly at Chakki Mor. The bench, while directing it to stop toll collection at the plaza, asked the NHAI to file a status report on October 30. The detailed order is yet to be uploaded”.
Project Director, Kalka-Shimla National Highway, Anand Dhaiya said, “We are yet to receive a copy of order.”
During the previous hearing on August 28, the court had said, “It is a matter of concern that the road remained closed at Chakki Mor on more than three occasions in July and August, and traffic was reduced to one-way, causing long jams of 5 km on either side”.
The court had rapped the NHAI for its failure to properly maintain the highway and cautioned that the collection of toll at Sanwara plaza could be suspended if urgent corrective steps are not taken.
