The Karnataka High Court on Friday granted anticipatory bail to Bhavani Revanna, mother of rape-accused ex-MP Prajwal Revanna, in a case of kidnapping a woman allegedly sexually assaulted by her son.
Bhavani Revanna’s counsel argued, “She was not arrayed as an accused in the FIR. It was against two named persons… they (prosecution) have obtained a warrant of arrest (from the trial court) when this anticipatory bail is pending before this court.”
The bench observed that with the issuing of an arrest warrant by the trial judge, it was likely that an arrest of the petitioner would render this bail petition infructuous. The bench also noted that the prosecution had opposed the grant of any interim relief as there was a possibility of Bhavani Revanna threatening witnesses and destroying evidence. The bench then stated that there would be no prejudice caused if interim anticipatory bail was granted subject to stringent conditions.
The Court then directed Bhavani Revanna to appear before the Investigating Officer at 1 pm on Friday and the following days, while she is not to be retained by the prosecution beyond 5 pm. She was also restricted from “entering or hovering” near the KR Nagar Taluk of Mysore district as well as the entirety of Hassan district or interfering with the investigation in any way. The Court stated this is “only an advance bail order… and not any prize”, so no celebration, procession, etc would be carried out by the applicant or anyone else.
The Court concluded by stating that it was open to the prosecution to ensure compliance with these conditions as well as seek recall of the bail order in case of a breach. The arrest warrant against Bhavani Revanna was also kept in abeyance. The matter is set to be heard further on June 14.
Meanwhile, the SIT case against bail for H D Revanna (father of Prajwal Revanna and JD(S) MLA for Holenarasipur) in the kidnapping case has also been adjourned to June 14, while H D Revanna’s own petition to cancel the case against him will be heard on June 21.
