A consumer court in Karnataka has ordered Decathlon, a sports equipment retail chain, to pay Rs 35,000 to a customer for failing to deliver a pair of trucking trousers worth Rs 1,399.
Mohith, a 23-year-old resident of Mangaluru, approached the District Consumer Disputes Redressal Commission in Dakshina Kannada after Decathlon failed to deliver the trousers he had ordered.
According to Mohith’s petition, on December 22 last year, he spoke to Decathlon representatives about buying Forclaz Trekking trousers MT-500 but was told that the product was available only at the chain’s store in Bengaluru’s ETA Mall. The executives asked him to pay the money online and assured him that the trousers would be delivered to his address.
Mohith paid Rs 1,399 online but never received the product. When he enquired with the staff of the Decathlon store at the ETA Mall, he was told that the product was missing.
On February 6, when Mohith visited the store at the ETA Mall, he was told that he would get his money back. However, he did not receive the refund even after he followed up his request with phone calls on February 10 and 13.
When Mohith sent a legal notice on April 9, he got the reply that the store at the ETA Mall had been closed. He then moved the consumer court, which sent notices to Decathlon, but the sport equipment seller never appeared before it.
In his order on Tuesday, Somashekarappa Handigola, president of the consumer court, ordered the company to pay Mohith Rs 1,399 along with Rs 25,000 towards deficiency in service and Rs 10,000 towards litigation costs.
