The Gujarat High Court on Wednesday refused to take up the application moved by Jaysukh Patel, Oreva Group managing director and key accused in the Morbi bridge collapse case, seeking interim bail even as his regular bail is pending before the court.
The court instead suggested that the regular bail plea will be heard on October 27.
Senior advocate Nirupam Nanavaty, representing Patel, submitted before Justice Divyesh Joshi he has now moved the interim bail application as the regular bail plea remains pending. Nanavaty pointed out it has not been taken up for hearing by the court due to lack of time.
Justice Joshi, however, suggested the main regular bail matter be heard as scheduled, on October 27, and did not take up the interim bail matter for separate consideration, instead posting the same for the same day.
Meanwhile, Justice Joshi, while addressing advocates representing two separate sets of victims of the incident — advocates Rahul Sharma and Ronith Joy — directed them to submit their written arguments or reply in advance.
Patel had surrendered on January 31 this year. He is facing charges of culpable homicide not amounting to murder after the Morbi bridge collapse in which 135 people were killed in October last year. His company was responsible for the operation and maintenance of the bridge.
Patel was named in the chargesheet submitted by the police on January 27, and his role has been attributed to directly supervising and issuing instructions about the repair and renovation of the bridge.
