The Morbi district and sessions court in Gujarat on Friday rejected applications filed by BJP worker Dharmendrasinh Zala and his brother Yuvrajsinh seeking protection against arrest in an illegal toll gates case, even as police are yet to achieve a breakthrough in the investigation.
Additional Sessions Judge Veerat Buddha rejected the pleas of Dharmendrasinh and Yuvrajsinh seeking anticipatory bail in the case where vehicles were allegedly diverted from National Highway 8A to Nava Vaghasia and to White House Tiles Pvt Ltd (WHTPL) near the authorised toll plaza in Vaghasia village and tolls were extorted from the diverted vehicles.
“We argued that there was a prima facie case against the accused. We highlighted that the accused had set up illegal toll gates near an authorised toll plaza set up by the government and that the applicants are not cooperating with police investigation in the case,” Sanjay Dave, additional government pleader of Morbi, told The Indian Express.
Dharmendrasinh is sarpanch of Vaghasia village and husband of Varshaba Zala, a BJP member of the Wankaner taluka panchayat. Varshaba was president of the taluka panchayat till early September.
The BJP worker, his brother, three other men from Vaghasia, and Amarshi Patel alias Amarshi Vansjaliya of WHTPL were booked on December 4 by the Wankaner town police for allegedly extorting tolls from vehicles after diverting them to Vaghasia and the WHTPL premises from NH8A.
Amarshi is the son of Patidar leader and industrialist Jeram Vansjaliya, whose family owns WHTPL. Police say that all the accused are on the run.
The Zala brothers moved the court on December 11 and it heard the matter on Wednesday but delivered its order on Friday.
