BMW hit-and-run accused pleads innocence on culpable homicide charge

Vismay Shah,accused in the BMW hit-and-run case in which two youths were killed,filed a discharge application before a district court Saturday requesting that charges against him under section 304 (2) of Indian Penal Code that deals with culpable homicide not amounting to murder should be withdrawn.

Shah’s lawyer filed the plea on the ground that there is no evidence in the chargesheet proving his client’s culpability. He said the CCTV footage clearly showed two bike-borne youths were coming from the wrong side and were not wearing helmets.

Shah,who is languishing at Sabarmati Central Jail,had rammed a motorcycle at Lad Society in Vastrapur in February this year,killing Shivam Dave (25) and Rahul Patel (21).

Earlier,Sha’s bail applications were rejected by all courts,including the Supreme Court.

Meanwhile,the victim’s family also filed an application requesting the court not to entertain Shah’s plea. The next hearing in the case is scheduled for July 31.
