Suspended IPS officer Sanjiv Bhatt has moved High Court in a 1994 custodial torture case in which he was accused of giving electric shocks to a man in police custody.
According to Bhatts counsel I H Syed,the case dates back to 1994 when the officer was the superintendent of police in Porbandar district. One Naran Sudha,allegedly involved in anti-national activities,was arrested by the district police in a criminal case. When he was produced before a magisterial court in Porbandar,Naran Sudha alleged that Bhatt and a constable had beaten him up in the custody and given him electric shocks. The magistrate had ordered criminal proceedings against Bhatt.
Bhatt had moved an application before the subordinate court concerned that the police inspector who was the investigation officer in the case in which Naran Sudha was arrested should be examined as a witness along with his case diary since rest of the witnesses were accomplices of Naran Sudha.
The lower court rejected the application following which Bhatt has approached HC,Syed said.
HC wants govt to inform convicts kin about welfare schemes for them
The Gujarat High Court (HC) Thursday directed state government to include the family background details of a convict in his history sheet being maintained by the concerned jail authorities and to inform the convicts about different welfare schemes for them as soon as they enter in the jail. The HC gave the directions during the hearing of a suo motu initiative taken by the court for the welfare of close relatives of the poor convicts.
A division bench of the HC comprising of Justices M R Shah and S H Vora is conducting the hearing in this regard. The bench initiated the matter while dealing with a temporary bail petition of a convict who had sought bail to arrange for the fees of his school-going son. Subsequently,the facts mentioned in the petition were found to be false. Meanwhile,the court has gone ahead with its initiative for the welfare of the relatives of the convicts with an observation that relatives of the poor convicts should not be suffering because of the imprisonment of the convicts as it is not their fault.
The court has appointed government pleader Prakash Jani to assist it in the matter. On Thursday,Jani informed the court about different government schemes for the welfare of the relatives of the convicts.
