There are over 38 lakh cheque bounce cases pending in various courts of the country under Section 138 of the Negotiable Instruments Act. Now,Union Minister for Law and Justice Veerappa Moily has written to Finance Minister Pranab Mukherjee asking him to get his ministry to set up special courts to handle these cases.
In his letter to Mukherjee,Moily has referred to the report of the Law Commission of India as well as the task force appointed by the government under the chairmanship of former Supreme Court judge M Jagannadha Rao in 2008. The task force recommended a methodology and infrastructure for institutionalising Judicial Impact Assessment in the law-making process.
The subject of Judicial Impact Assessment was first raised by former Union Law Secretary T K Vishwanathan,who pointed out the huge potential for cost cutting if government departments calculated the likely cost of implementing a legislation and also ensuring timely justice delivery system.
The Law Commission in its 213th report had recommended that pendency of large number of cases relating to cheque bouncing tarnished the image of business. It said cheque bounce cases needed to be speedily disposed of through this measure so that litigants didnt lose faith in the judicial system.
