Land law violators face music

PUNE, July 22: Taking serious note of growing complaints of violation of Land Revenue Code in Koregaon Park, District Collector Vijay Kumar Gautam had ordered an extensive survey of all 154 plots in that area.

The officials said survey of about 100 plots was already completed and 52 notices were issued to 42 individuals, housing societies and public trusts in the last week for violation of buildings by-laws and using the building for commercial purposes. Two separate notices have been issued to Osho International. Besides, notices have also been served on related foundations including Neo Sannyas Foundation, Sundaram Foundation, Satyam Foundation and Abhilasha Foundation.

Officials dealing with the matter in the collectorate said action was taken following a large number of complaints that several property owners were running lodges or hostels without obtaining any permission from any government agency. The sources said the lodges are being mainly run for foreign nationals.

Gautam today told The Indian Express that action was taken since special building by-laws applicable to 154 plots in Koregaon Park Scheme were prima facie found violated. He said all the defaulter individuals, housing societies and public trusts have been sent notices under section 45 of the Maharashtra Land Revenue Code, 1966.

Individuals, housing societies and public trusts, which have been sent notices, have been asked to submit their say within 15 days. The hearings have been scheduled on July 27, August 3 and 4.

It may be recalled that the district collector had sealed Sundarban Hotel belonging to Talera Hotels chain few months ago on the same grounds. The hotel owners challenged this in the High Court.

Taps turn dry for two more restaurants
In the meantime, the Pune Municipal Corporation today disconnected water supply to two restaurants on North Main Road in Koregaon Park area for not having a licence from the health department and even not having building completion certificates.

Additional Municipal Commissioner Deepak Kapoor said in a press note that the owners of the two restaurants, Malayka Spice and Aurthor Theme in front of Vrindavan Apartments have also been served notices under section 53(1) of the Maharashtra Regional and Town Planning (MRTP) Act for occupying the structure without the completion certificate. This can lead to criminal prosecution of the owners if they fail to give a satisfactory reply.

Kapoor said that acting on complaints lodged with the civic body by residents of the neighbourhood that kitchen waste from the two restaurants was being discarded by the roadside, thereby creating a health hazard, he himself visited the area on Wednesday morning and confirmed the default. He said he was surprised to see that there was a waste collection container of the municipal corporation and yet the waste was being dumped by the road side.

He was shocked to note on returning to his office that the two restaurants had begun functioning when the building still had not been granted completion certificate and that the establishments did not have the licence from the civic health department.
