The Delhi High Court today admitted the appeal of former Assistant Commissioner of Police R P Tyagi, who was sentenced to death on December 14 in a 1987 custodial death case, even as it summarily dismissed his plea for bail on health grounds.
A fast-track Court had held Tyagi and guilty of the murder of Mahendra Kumar, who succumbed at LNJP Hospital to injuries sustained after Tyagi and two other police officers beat him up in custody at Vivek Vihar police station almost two decades ago. In his appeal, Tyagi contended that the lower court had “totally misconstrued the evidence and erred on law as well as facts”.
