The Supreme Court today asked the Patna High Court to produce details of the transfer of Special CBI Judge Yogendra Prasad who was hearing the disproportionate assets case against Railway Minister Laloo Prasad Yadav and his wife Rabri Devi.
The direction came from a bench of Justice S N Variava, Justice A R Lakshmanan and Justice S H Kapadia. The court is hearing a PIL by Rajiv Ranjan Singh ‘Lallan’, who was the original petitioner in the fodder scam cases. Observing that it did not want to be “presented with a fait accompli”, the court also sought information about the new judge, Munnilal Paswan, who replaced Prasad.
Lallan had challenged the transfer of the judge when he had almost completed hearing in the case and claimed that this would delay the verdict. He alleged that the transfer was done during the “summer vacations (of the court) to overreach and present a fait accompli to the Supreme Court” and amounted to contempt of the apex court.
The case will be heard on September 20.
