Supreme Court’s move to ‘catch ’em young’: What the top court said about district judge appointment and why

The Supreme Court has issued an order that has the potential to overhaul the judicial system and promote excellence. In its order, the Supreme Court said that judicial officers, who have already completed 7 years of practice as advocates, are eligible to become district judges under the bar quota.

Why the judgment?

As per the judgment: “Letting go of the emerging talent by not identifying at and nurturing them at the earliest would lead to mediocrity as against the excellence, which would weaken the foundation and undermine the judicial structure. It is obvious that greater competition will serve a better quality.”

Stating that the interpretation of Constitution has to be “organic” and not “pedantic”, the apex court asked states to amend rules accordingly with consultations with the respective high courts to allow judicial officers to take up exam for district judges.

When will the judgment be implemented?

“All the state governments in consultation with the high courts shall amend the rules in accordance with what has been held by us within a period of three months,” the judgement said.

Who issued the order?

A four-judge bench led by CJI B R Gavai passed the order. The others on the bench were Justices M M Sundresh, Aravind Kumar, S C Sharma and K Vinod Chandran.
