Nirav Modi, Choksi summoned by court under new fugitive offender law

A SPECIAL court has issued summons to absconding accused Nirav Modi and Mehul Choksi directing them to appear before it in September after the Enforcement Directorate filed a plea under the recently promulgated Fugitive Economic Offenders Ordinance. While Modi has been directed to appear before the court on September 25, Choksi will have to appear before it on September 26.

The ED had earlier moved an application under section 4 read with section 12 of the Ordinance before the special court designated under the Prevention of Money Laundering Act. As per provisions of the Ordinance, if the two fail to appear before it to respond to the ED plea, the court can allow the ED application and the central government can proceed with confiscating Modi and Choksi’s properties, including the proceeds of crime in India or abroad, whether or not it is owned by them and any other property or benami property owned by them.

This will include movable and immovable properties identified by the ED in India, United Kingdom and UAE. According to the Ordinance, the process of confiscation of such offenders can be permitted even before the trial against them is allowed.

Last month, ED has similarly sought to declare Mallya a ‘fugitive economic offender’, the first such plea under the Ordinance.).
