The Delhi High Court Monday granted AltNews co-founder Mohammed Zubair liberty to move trial court for seeking possession of his mobile phone seized by the Delhi Police in connection with a 2022 FIR. The HC disposed of a 2022 plea by Zubair seeking quashing of a June 28, 2022 order by a magistrate court at Patiala House where he was remanded to four days’ custody of the special cell police station. He was subsequently granted bail by sessions court in July 2022 in the case.
The Delhi Police Special Cell had filed an FIR against him in June 2022 in connection with his tweet in 2018 under IPC sections 153A (promoting enmity or hatred between different groups based on religion, community) and 295A (deliberate and malicious act that insults religion or religious beliefs).
Zubair had also sought the HC’s direction that any device or document seized from him, which is beyond the allegation of the FIR, be “forthwith restored” to his family. While the relief challenging the four days’ remand has become infructuous now, Justice Swarana Kanta Sharma while dealing with the plea Monday, recorded that “it is not specified as to which devices or documents the petitioner is referring to which have been seized by the respondent that are beyond the allegations in FIR.”
“…it was observed that the counsel for petitioner is referring to the mobile phone of the petitioner…he may move an appropriate application before the concerned area magistrate…,” Justice Sharma recorded.
