2G scam: Centre directs Balwa to Supreme Court

Balwa had pleaded to the court that he was wrongly linked to the underworld.

The apex court,monitoring the probe in the 2G spectrum case,has restrained other judicial bodies from passing any order on related matters,the Centre told the Delhi High Court on Wednesday while responding to the plea of former Swan Telecom promoter Shahid Usman Balwa that he was wrongly linked to the underworld.

“The minutes of meeting of the Foreign Investment Promotion Board,which forms the subject matter of the present petition (of Balwa),was produced before the Supreme Court which is seized of the case relating to the 2G Spectrum,” the affidavit,filed by Under Secretary of Finance Ministry A K Srivastava,said.

The six-page affidavit of Srivastava cited an order of the apex court which said “since this court is monitoring the investigation of the 2G spectrum,we direct that no court shall pass any order which may,in any manner,impede the investigation being carried out by CBI and the Enforcement of Directorate.”

Additional Solicitor General A S Chandiok said the affidavit has already been filed by the Centre after Justice S Muralidhar pointed out that it has not come on record.

Meanwhile,the counsel for Balwa sought an urgent hearing of the plea saying “it is related to his prestige.” The court then posted the matter for further hearing on April 24.
