The Supreme Court has asked the Haryana government to furnish details as to how many below poverty line (BPL) families in the state have toilets in their households. The poser came as the court heard a case relating to panchyat polls in which one of the criteria is that a candidate must have a functional toilet in his/her house.
During a hearing last week, a bench led by Justice J Chelameswar asked Attorney General Mukul Rohatgi, appearing for Haryana, to have an appropriate affidavit filed in the court regarding the number of toilets. Rohatgi had sought to justify fixation of minimum criteria, including that of a toilet in the house of aspiring candidates, and said around 7 lakh BPL households, out of a total of 8.5 lakh BPL homes in the state, have toilets.

On a batch of petitions challenging the new law, the top court has suspended the operation of the Act and is hearing the matter finally to adjudicate its constitutional validity.
Haryana has defended the recent amendment in the state law, fixing minimum educational qualifications and other criteria, by saying that the representatives should lead by example as they need to perform various government functions.
