Trinamool Congress leader Mahua Moitra, who was expelled from the Lok Sabha, on Wednesday urged the Supreme Court to list her plea challenging the expulsion for hearing urgently.
Senior Advocate A M Singhvi, appearing for Moitra, requested Chief Justice of India D Y Chandrachud to take up the matter either Thursday or Friday.
The CJI asked him to send an email to the Registrar, as is the standard practice, so that he can look into it.
Earlier, Moitra’s plea was mentioned before a bench presided by Justice S K Kaul as the CJI was sitting in a constitution bench. But Justice Kaul, who is due to retire on December 25, asked the senior counsel to mention it before the CJI after the Constitution bench rises in the afternoon.
Moitra was expelled from the Lok Sabha on December 8 after the members adopted the report of its Ethics Committee that found her “guilty of unethical conduct”. The report also called for “an intense, legal, institutional inquiry” by the government “in a time-bound manner” into the cash-for-query allegations against her.
The motion moved by Parliamentary Affairs Minister Pralhad Joshi stated: “This House, having taken note of the first report of the Committee on Ethics on complaint given by Nishikant Dubey MP against Mahua Moitra MP, wherein she has been found guilty of unethical conduct and contempt of the House for sharing her Lok Sabha credentials i.e. her email ID and password of the Lok Sabha members portal to an unauthorised person and its irrepressible impact on the national security.”
“Wherein her conduct has further been found to be unbecoming of a member of Parliament for accepting illegal gratification through gifts and other facilities from a businessman to further his interest which is a serious misdemeanour and highly deplorable conduct on her part, accept the recommendations and findings of the committee and resolve that continuance of Mahua Moitra as member of Parliament, member of Lok Sabha as untenable and she may be expelled,” it added.
Moitra was accused of accepting cash to ask questions on behalf of businessman and friend Darshan Hiranandani.
In an interview with The Indian Express on October 27, Moitra admitted she gave her Parliament login and password details to Hiranandani, but denied taking any cash from him, as alleged by Supreme Court advocate Jai Anant Dehadrai in his complaint to the Central Bureau of Investigation (CBI).
