Dismissing a request from Rajesh and Nupur Talwars counsel,who sought permission to confront a prosecution witness,a sessions court in Ghaziabad Tuesday said: The application has been made with the sole intention to waste the courts time,therefore,it must meet its Waterloo.
The counsel last Thursday asked for the statements of police photographer Chunni Lal Gautam,who told the investigating agency in 2008 and 2010 that he didnt see any bloodstain on the walls of the room at the Noida home where teenager Aarushi Talwar was murdered.
Talwars counsel alleged that during his account to the court,he said he saw bloodstains on the walls and on Aarushis toys.
However,Additional Sessions Judge Shyam Lal disallowed the application,saying it was redundant because cross-examination of the witness was still on.
The court directed the CBI to produce before it the original tape (a cling film-type of material) on which fingerprints from the crime scene were taken. The CBI has earlier told the court that the tapes were irrelevant.
The defence lawyers had argued that the original tapes had 17 fingerprints from the crime scene,but none of them turned out to be inhabitants of the house.
