Give 72-hour notice to Seolekar before arresting him: judge to police

Additional sessions judge JD Kulkarni directed the police on Wednesday to give 72-hour notice to builder Anil alias Aniruddha Seolekar before arresting him in an alleged land grab case. On June 25,the court had ordered police to probe a land grab case involving Seolekar and eight other persons.

Seolekar had moved the court with anticipatory bail application in July. “The court dismissed the petition and directed police to allow 72 hour notice to Seolekar before arresting him in the case,” said advocate Rahul Lonandkar on Thursday. Seolekar had also submitted an appeal in the Pune sessions court against police probe in the land grab case. The case will come up for hearing on September 18.

According to Lonandkar,the complaint was filed against nine parties — Pinni Co-operative Housing Society,its office-bearers Parag Shah and Rajendra Uttamchand Dugad,Intel Shelters Pvt Ltd,its directors Aniruddha alias Anil Seolekar and Anandram Dagduram Mutha,Panasiya Construction Company —partnership firm represented by Mutha,Sushma Rajendra Gaikwad (daughter-in-law of the complainant) and Sushma’s father Subhash Kashinath Jadhav.

“Gaikwad is the owner of a plot with survey numbers 9-14 of Mauje Mundhwa,Hadapsar. The 7/12 extract documents of the land have Gaikwad’s name. But Seolekar and others prepared a fake power of attorney (PoA) in Gaikwad’s name. Using the fake PoA,the suspects had sold the land to Pinni Cooperative Housing Society without taking Gaikwad’s consent,” he said.

“Gaikwad filed several complaints with the police. But there was no response. So he filed a court complaint against Seolekar on May 10.” The court order said “Gaikwad had not executed the power of attorney document in favour of the accused in respect of land S. No 9 to 14 of village Mundhwa,nor has he executed any development agreement or sale deed/conveyance deed in favour of any accused.”

Seolekar said the allegations were false. “This is a civil case going on in the court for the past five years. There has been no evidence till now. A criminal case has been filed to circumvent civil proceedings,” he said.
