Special court rejects bail plea of Abdul Kadar in Cordelia drug raid case

A special court on Wednesday rejected the bail application of Abdul Kadar, who was arrested in 2021 by the Narcotics Control Bureau (NCB) in the Cordelia drug raid case. Kadar and Nigerian national Chinedu Igwe continue to remain in custody while the others booked after a raid on the cruise on October 2, 2021, are out on bail.

On October 18 this year, the Bombay High Court had directed the special court to decide on the bail plea within a month. The NCB had arrested Kadar on the basis of the statement of a co-accused.

Opposing his bail, special public prosecutor Amit Munde submitted that 2.5 grams of ecstasy and commercial quantity of 54.3 grams of mephedrone were seized from him.

In his plea filed through lawyer Apoorv Srivastava, Kadar had said that there were no allegations linking him to the raid and that the NCB had not made any recovery from him and had planted the drugs. The plea said that the entire recovery is rendered meaningless as the NCB officials had violated Section 50 of the Narcotic Drugs and Psychotropic Substances Act, which requires that a suspect is searched by a gazetted officer. The plea said that Kadar was searched by NCB officials part of the raiding team instead. He had also said that the search was conducted in the presence of habitual panchas or independent witnesses.

Kadar had further said that both the alleged supplier and the alleged customer, on whose statement Kadar was arrested, were granted bail.

SPP Munde had denied the allegations of violations made by Kadar. He submitted that samples were drawn from the seized drugs in the case and the forensic analysis had confirmed the presence of narcotics and psychotropic drugs.

Twenty persons were booked in the case initially by the NCB. Charges were dropped against six persons including Aryan Khan, son of Bollywood actor Shah Rukh Khan in 2022.
