Mumbai court disposes of MHA plea in data leak case

The special court said that initially the Mumbai police was investigating the case registered in 2022 related to alleged leak of data of intercepted calls.

Noting that the CBI had filed a closure report in connection with its probe in the data leak case, a special court disposed of a plea filed by the Ministry of Home Affairs against a magistrate court order where the ministry was directed to hand over certain documents and a pen drive linked to the case to the Mumbai police. The MHA through Home Secretary had filed a revision application against the order.

The special court said that initially the Mumbai police was investigating the case registered in 2022 related to alleged leak of data of intercepted calls. After the change in government in the state, the case was transferred to the CBI. In June, the CBI filed a closure report in the case stating that it is closing its probe in the case. The plea is pending for orders.

“In view of the aforesaid subsequent events, the very purpose of filing this revision application becomes infructuous,” the court said, dismissing the plea.

An FIR was registered by the Cyber police station on March 26, 2022 on behalf of the then Assistant Police Commissioner of SID. The FIR referred to a press conference held on March 23, 2022, by Devendra Fadnavis, who was then the Leader of Opposition, in which he had spoken about calls between senior police officials and a private person for postings. The FIR said that Fadnavis had also shown a pen drive stating that it had over 6GB of data related to the calls which was handed over to the MHA. The Mumbai police had sought access to the data for its probe.
