Lawyer Surendra Gadling, who is facing charges in the Elgaar Parishad case, filed a plea before a special court on Thursday seeking action against the Navi Mumbai police commissionerate stating that a government resolution on reserving police to escort undertrials to court is being flouted.
Last week, Gadling and six others had gone on a hunger strike to protest not being brought to court for three hearings from Taloja jail where they are lodged.
Gadling and the six others were produced before the court on Thursday. He submitted that undertrials from the jail were not being regularly produced in court with the reason given that sufficient guards were not available to bring them.
Gadling sought that action be taken against the police authorities who he said are required to not utilise reserved police personnel for other purposes. The court has sought a say from the prosecution
Gadling also sought issuing a contempt notice against Taloja jail authorities for not giving him a cot, despite a court order passed on August 14. Gadling said he suffers from various ailments and the court had permitted him the use of a cot but it was not provided by the jail superintendent, ‘defying court orders’.
Gadling also filed a separate plea seeking permission to walk within the jail premises in the morning and evening. He submitted to the court that the barracks he was lodged in was overcrowded and there was very little space within the prison circle for a walk. Citing a previous order by the court permitting his co-accused Gautam Navlakha for a walk, Gadling said that he suffers from various deficiencies including Vitamin D and sought permission for the walks.
The court is likely to decide on the pleas on November 7.
