In a move that is set to allow redevelopment of buildings and permit them to go taller in areas such as Santacruz, Vile Parle and Kurla that are in the vicinity of the airport, Deputy Chief Minister Eknath Shinde, who is also the Housing Minister, on Wednesday announced that the state government has made an amendment to the Brihanmumbai Development Control and Promotion Rules-2034. The amendment will allow the redevelopment of buildings affected by height restrictions in the funnel zone of the airport.
Shinde said areas such as Santacruz, Vile Parle and Kurla fall in the airport funnel zone and height restrictions hinder the redevelopment of buildings in those areas.
While making the announcement in the Maharashtra Legislative Council, Shinde said, “If the site cannot be used due to height restrictions, then the Transferable Development Right (TDR) of that area will be made available to the owner.” He further said this will make the redevelopment of old buildings in the affected areas of the restricted Brihanmumbai area affordable.
Shinde said in order to facilitate the redevelopment of old buildings in the airport funnel zone with height restrictions in the Greater Mumbai area, approval has been given to make a separate provision in the Greater Mumbai Development Control and Promotion Rules-2034.
The Deputy Chief Minister said it has been decided to make available to the owner the TDR of the basic carpet area or the area occupied by the official building, whichever is higher, if such area cannot be used on the site due to height restrictions.
“It has also been decided to charge a concessional rate for the surcharge to be paid for the deficiency in open space and for not including stairs, lifts, etc. in the carpet area index. Accordingly, a notice of amendment is being issued under Section 37 (1A) of the Maharashtra Regional and Town Planning Act, 1966,” he said.
Several local residents associations and residents have been demanding a solution to the issue for several years.
