Chief Minister Eknath Shinde will not get disqualified, and, therefore, all the speculations about a change in the leadership in Maharashtra are baseless, Deputy CM Devendra Fadnavis has said.
While speaking to a private TV channel, Fadnavis said Saturday, “Based on earlier Supreme Court and Election Commission of India orders, one can easily arrive at the conclusion that Eknath Shinde will not get disqualified”.
Even if it is presumed that Shinde will be disqualified, Fadnavis said, “He still does not lose the CM post. He can become a member of the State Legislative Council.”
To hold the post of a minister, including that of the CM, an individual has to be a member of either the state Assembly or the Council.
Fadnavis said, “The disqualification case is being heard by Maharashtra Assembly Speaker (Rahul Narwekar). So, I don’t want to comment on the matter”.
The Shiv Sena (UBT) led by Uddhav Thackeray has filed a petition demanding the disqualification of 16 MLAs, including Eknath Shinde, for what it termed a violation of the party’s whip.
On its part, the Shinde faction has argued they are the original party and have also sought the disqualification of Shiv Sena (UBT) MLAs.
In June 2022, after Shinde rebelled, 40 out of the 56 MLAs defected from Thackeray’s party to Shinde’s side. While the Shiv Sena led by Shinde has 40 MLAs and 13 MPs, the Shiv Sena (UBT) is left with 16 MLAs and six MPs.
