DNA mismatch with baby: Woman sues hospital

According to police, the case was registered under section 336 (Act endangering life or personal safety of others) and 34 (common intention) of the Indian Penal Code on Tuesday.

A 41-year-old woman has lodged a complaint with the Bhoiwada police alleging that her newborn was interchanged by the medical staff at Wadia hospital. The police said that the woman submitted a complaint application recently after there was a mismatch in the DNA test which the woman had privately conducted.

According to police, the case was registered under section 336 (Act endangering life or personal safety of others) and 34 (common intention) of the Indian Penal Code on Tuesday.

Police said that the complainant is a resident of Prabhadevi and her husband is employed with a garment manufacturing company.

An officer said, “The woman gave birth to a baby at Wadia hospital on June 7. She had taken her newborn home, however, as she felt that her baby’s features did not match with her or her husband, she decided to undergo a DNA test.”

The reports showed that their DNAs did not match, said police. “We conducted a primary inquiry and consulted legal experts after which a case was registered against the hospital staffers,” said police.

Deputy Commissioner of police Prashant Kadam (zone IV) said, “We have not arrested anyone yet. We will hold an inquiry and take legal action accordingly.”
