Developer booked for not providing flats to buyers after accepting Rs 100 crore

The accused allegedly diverted the funds for personal use, police said. In one case, the developer allegedly sold the same flat to two persons.

THE MUMBAI police Wednesday registered an FIR against a real estate developer for allegedly not providing flats to homebuyers at a high-end building in Wadala after receiving ₹100 crore from them.

The accused allegedly diverted the funds for personal use, police said. In one case, the developer allegedly sold the same flat to two persons.

An official said that while a complaint had been received earlier, the Economic Offences Wing (EOW) registered the FIR after the preliminary inquiry found that prima facie an offence was made out. The complainant in the case is a 62-year-old chartered accountant, Anil Dron who is a resident of Kandivali, an official said.

The official said that the accused, real estate developer Subbaraman Anand Vilaynur, his wife Uma Subbaraman, B P Gangar Constructions and other unidentified persons, collected ₹100 crore from 102 persons in the name of “Sky 31” housing project in Wadala (West) since 2018, promising each a flat as per the complaint given by Dron.

After collecting money from the homebuyers, the accused allegedly conspired to divert the funds to their personal and other bank accounts instead of using them for the housing project, the official said.

The official added that the accused also sold one flat to two persons after taking money from both and cheated them as well, he said. The EOW registered the case against the accused on charges of cheating and criminal breach of trust, the official said.

The case is currently being investigated by Banking Unit–3, Cell 11 of the Economic Offences Wing. An FIR has been registered under Sections 420 (cheating), 406 (criminal breach of trust), and 34 (common intention) of the Indian Penal Code (IPC) .
