Centre asked to reply on functioning of CBI courts

Hearing a petition filed by a city-based advocate on this issue on Monday,the Division Bench of Justice J N Patel and Justice Amjad Sayed directed the Centre to file an affidavit on the steps they are taking to solve the issue in three weeks.

Advocate Ishwariprasad Bagaria in his petition said the special courts set up under various Acts such as Prevention of Corruption Act,Maharashtra Control of Organised Crime Act,Narcotics Drugs and Psychotrophic Substances Act do not have enough judges and public prosecutors.

Last month,the High Court had asked the state government to explain the situation in courts set up under state Acts. According to Bagaria,though there are five special courts which handle CBI cases,only three courts are functional now.

Around 2000 cases are pending before CBI courts in Mumbai,claimed Bagaria. He said not a single CBI trial was taking place outside Mumbai and more than 2000 cases were pending.

Going deeper into the issue,Justice Patel said the CBI was lacking in all aspects. Your own officers are called corrupt,Justice Patel said. However,Additional Solicitor General Darius Khambatta admitted that they (CBI) need to organise themselves in a proper way.
