The Bombay High Court on Thursday quashed and set aside the Look-Out Circular (LOC) issued against city developer and former Member of Parliament (MP) Akhtar Hasan Rizvi, of Rizvi Land Developments Pvt Ltd by Union Home Ministry, based on the recommendation of state EOW.
A division bench of Justices Revati Mohite-Dere and Manjusha A Deshpande passed an order in Rizvi’s plea filed last year.
Rizvi was booked in an alleged cheating case involving a family that had invested in a project of his in Kalina, initiated in 2012 by the former director of Rizvi Land Developments Pvt Ltd, which has since been amalgamated into Rizvi Estates and Hotels Private Limited.
Rizvi, who is nearly 82 years old, has been named as an accused in a case registered at Vakola Police Station, which was subsequently transferred to the EOW (Economic Offences Wing) in Mumbai. The charges against him include cheating and other offences under the Maharashtra Ownership of Flats (Regulation of the promotion of construction, sale, management, and transfer) Act, 1963.
Last year, the HC had granted permission to Rizvi to travel abroad from June 20 to July 18, 2023 as he sought to visit London for medical treatment and his daughter’s engagement, Senior advocate Rajiv Chavan for Rizvi had then argued that EOW had previously granted him permission to travel abroad for medical treatment after suspending the LOC, and Rizvi had returned to India, albeit later than expected. The reason for the delay in his return was his health condition and ongoing treatment at the Mayo Clinic Healthcare in London.
