The Bombay High Court on Monday rejected a review petition against an order of dismissal of a plea challenging election of Shiv Sena (UBT)’s Sanjay Dina Patil from North-East Mumbai Lok Sabha constituency last year.
Petitioner Shahaji Nanai Thorat had filed a review petition after the single-judge bench of Justice Sandeep V Marne on November 26, 2024 had rejected his election petition against Patil.
On Monday, Justice Marne, while dismissing the plea said that he had taken a view in November last year and he could not correct it himself, therefore, Thorat was entitled to file an appeal.
Thorat, a taxi driver, had alleged that Patil’s election was invalid as he did not mention his parents’ names in the nomination papers, which was mandatory.
Justice Marne in November last year had rejected the plea stating that the petitioner had not made 18 contesting candidates from the said constituency as party respondents to plea. Therefore, mandatory provisions to file election plea were not complied with.
On Monday, the judge dismissed a review petition on the issue of maintainability stating that he had not gone into the merits of the matter.
