Antilia terror scare case | ‘Convict on parole not expected to indulge in crimes’: Court rejects bail plea

OBSERVING THAT when a convict is out on parole, he is expected not to indulge in any unlawful activity, a special court in a recent order rejected bail to a dismissed constable in the Antilia terror scare case. The bail application of Vinayak Shinde, arrested in March 2021, was rejected by the court last week and the detailed order was made available on Monday.

While the National Investigation Agency (NIA) has invoked anti-terror charges in the case, Shinde has been booked under charges of criminal conspiracy and extortion of the Indian Penal Code and not the Unlawful Activities (Prevention) Act. In his bail plea, Shinde had said that two other co-accused, who were also not charged under the UAPA, were granted bail in the case and his release on bail should also be considered. Shinde, however, was already serving life imprisonment for his involvement in the fake encounter of Lakhan Bhaiya and was out on parole in 2021.

The NIA had claimed that when out on parole, he had assisted dismissed cop and co-accused Sachin Waze in procuring SIM cards for the conspiracy to plant gelatin sticks in an SUV near Antilia, the residence of industrialist Mukesh Ambani.

“The gravity of the act committed by the applicant went serious when he committed the same after getting parole leave. It is not expected that the person on parole leave should engage in the criminal activity. On the other hand, it is expected that he should not engage in the unlawful activities and therefore, the present applicant cannot be equated with the other accused for giving benefit of parity,” special Judge A M Patil said in his order.
