Ahead of Dahi Handi,HC asks state,TMC & mandals to talk

In view of the upcoming Dahi Handi celebrations,the Bombay High Court on Thursday asked representatives of the state government

In view of the upcoming Dahi Handi celebrations,the Bombay High Court on Thursday asked representatives of the state government,Thane Municipal Corporation and neighbourhood Ganesha mandals to organise a meeting to discuss the issue of noise pollution.

A Division Bench of Justices Ranjana Desai and R G Ketkar was responding to a public interest litigation filed by Thane doctor Mahesh Bedekar,demanding strict implementation of noise pollution regulations,especially in silence zones.

“The petitioner,along with officials from the state government,the municipal corporation and representatives of the mandals should have a meeting on Saturday to ensure that the Dahi Handi festival is celebrated without causing inconvenience to anyone,” said Justice Desai.

Noting that the state has not identified silence zones in the city and laid down regulations on them,Justice Desai said,“All of a sudden,the police cannot now go around arresting people.”

Calling for a sense of balance,the judges said,“The Supreme Court has already covered everything in this matter,and has taken into account the aspects related to India’s culture and its diversity. It is important to be aware of public sentiments.”

The court also criticised the petitioner for moving the court at a late hour,saying,“We wish that the petitioner had moved this petition at least two months before the festival. Now,Dahi Handi is just round the corner.”

In September last year,the High Court had asked the state government and the Thane civic body to ensure that Ganesha and Janmashtami mandals follow noise pollution regulations and had directed that a committee be formed in this regard to chalk out a plan to avoid chaos during festivals. The next hearing in the case is scheduled for Wednesday.
