A 10-year-old school girl died while her brother suffered minor injuries in a road accident in Bandra Kurla Complex on Wednesday.
Police arrested a cement mixer driver and also named an autorickshaw driver in the case as he was using a two-wheeler despite the kids’ parents paying him to pick them up and drop them to and from school in an autorickshaw.
The deceased girl has been identified as Shifa Shaikh, a class four student. Her brother Umar Shaikh (6), who studies in class two, suffered minor injuries.
According to the police, on Wednesday the two kids were picked up from their respective schools by auto-rickshaw driver Jaffar Pathan, who was dropping them home to their house in BKC on his bike.
At Platina junction, on the BKC-Kurla road, a speeding cement mixer rammed the two-wheeler Pathan was riding. Due to the collision, Shifa fell down and came under the wheels of the heavy vehicle. Umar also suffered minor injuries.
Pathan informed the parents and rushed Shifa and Umar to the Sion hospital. When the parents reached the hospital, they discovered that the doctors declared Shifa dead.
Sohail told the police in his statement that his family was informed by Umar that he and Shifa had told Jafar not to speed his bike, but he continued. Sohail also told police that he paid Jafar for an autorickshaw service and not a bike and he did it without informing them.
Sohail in the FIR stated that when he asked Jafar why he was not using his autorickshaw, he told him that he was avoiding it as his autorickshaw documents were not in order and he was getting penalised for it often.
Based on Shifa’s father Sohail Shaikh’s complaint, police booked cement mixer driver Altaf Faruq Ahmed in a case of causing death by negligence.
Yogesh Chavan, BKC police station in-charge, said that auto driver Pathan was also arrested on charges of causing death by negligence as he was supposed to pick up and drop kids in his auto-rickshaw, but used his bike instead.
Police have booked the two under sections 106(1), 125, 125(a), 125(b), 281 of Bhartiya Nyay Sanhita BNS and 184 of Motor Vehicles Act.
