Talwars move SC for plea on witnesses

Want 14 summoned to trial court,SC hearing on May 28.

Two days after they failed to convince the Allahabad High Court,dentist couple Rajesh and Nupur Talwar moved the Supreme Court on Friday,seeking examination of 14 additional witnesses ignored by the CBI in the Aarushi-Hemraj double murder trial.

The counsel for the couple mentioned the matter before a vacation bench led by Justice B S Chauhan,which fixed it for hearing on May 28. This is the second time this month the parents of the murdered teenager have approached the apex court for a directive to the CBI and the trial court to get 14 additional witnesses examined.

The court had earlier refused to entertain their plea,noting they bypassed the first forum of appeal,the High Court. The apex court had also pulled them up for wasting the time of the court while suggesting they first move the High Court if they were aggrieved with the trial court’s decision to not ask 14 more witnesses to appear in court.

Subsequently,the couple moved the High Court,but it dismissed their petition on May 21,stating there was no need to force the prosecution (CBI) to call witnesses other than those it deemed proper. It had further said that the trial court had the right to decide which of the witnesses should be summoned and their statements recorded.

There being no stay on the trial at any stage of these proceedings,the trial court has gone ahead with recording the statements of Rajesh and Nupur Talwar as the main accused in the 2008 murder case. Rajesh’s statement ended on Thursday with the court asking him 805 questions. The court then started recording the statement of Nupur Talwar.
