Matia Mahal MLA Shoaib Iqbal,accused of aiding the illegal construction of a mosque near Jama Masjid,has moved the Delhi High Court to restrain the Archaeological Survey of India (ASI) from demolishing the structure.
Iqbal filed the plea following a High Court order,which directed the ASI to demolish the illegal construction to ascertain if the remains of a Mughal-era mosque existed at the Metro project site near Subhash Park in Central Delhi. The application is likely to come up for hearing on August 17 before a three-judge bench,headed by Acting Chief Justice A K Sikri.
Iqbals application also asked for the constitution of a committee to oversee the ASI action. It suggested the names of former Chief Justice of Delhi High Court Rajender Sachar,Jamia Milia Islamias Vice-Chancellor Najeeb Jung and ASI former Director K K Mohammad as members of the committee.
The court had taken suo-motu cognisance of the illegal construction of the mosque and asked the ASI to demolish it and file a status report on its investigation to ascertain if the remains of the mosque did indeed exist.
