The Delhi High Court on Friday instructed the Delhi Police to verify the wedding date of Vikas Yadav, the convict in the 2002 Nitish Katara murder case.
The directions came on a plea by Nitish’s mother, who sought initiation of perjury proceedings against Vikas for deliberately making false statements before the court to avail the benefit of bail. He had earlier sought an extension of his interim bail for his wedding on September 5.
Vikas, son of strongman-politician D P Yadav, had abducted Nitish from his classmate’s wedding in Ghaziabad, along with two others, and killed him — over Nitish’s relationship with his sister, Bharti.
In her application, Neelam Katara stated that Vikas had shared “false and fabricated” information; she submitted two photographs to show that he was actually married on July 5 at ‘The Aura’ in Noida’s Sector 74.
Vikas’s counsel, on the other hand, claimed that the July 5 photos were from his engagement ceremony.
Notably, the High Court on September 9 had dismissed Vikas’s plea for an extension of his interim bail, primarily on the grounds of maintainability and jurisdiction. He was out on interim bail granted by the Supreme Court to care for his ailing mother.
Arguing before Justice Ravider Dudeja, advocate Vrinda Bhandari — appearing for Neelam — said that while Vikas got married in July, he knowingly made false statements before the Delhi HC that his wedding was scheduled on September 5 to avail the benefit of interim bail, “causing grave hindrance to the sanctity of the judicial process and administration of justice”.
Neelam sought “initiation of appropriate criminal proceedings” against Vikas for commission of offences under BNS sections 227 (giving false evidence), 231 (giving or fabricating false evidence), 234 and 235 (false certificate) for “intentionally and deliberately making false statements on oath, as well as producing false evidence, with the mala fide intent to avail undue benefit of interim bail” from the Delhi HC.
Justice Dudeja issued notice to the Delhi Police and Vikas, directing the police to verify the date of Vikas’s wedding and submit a status report before the court.
In 2016, the SC confirmed the conviction and sentence of a 25-year jail term without any benefit of remission to Vikas and his cousin Vishal in the case. Another co-convict, Sukhdev Pehalwan, was also handed a 20-year jail term in the case.
