Misspelt name of Sunjay Kapur and Priya Kapur’s son, wrong residential address of his children with actor Karisma Kapoor, bequeathal provisions for Priya’s daughter from her first marriage, no specifics of Sunjay’s cryptocurrency investments — these were some of the “bloopers” in Sunjay Kapur’s will flagged to the Delhi High Court on Monday, raising questions over its authenticity.
The submissions came from Kapur’s children with actor Karisma Kapoor — Samaira and Kiaan — who are locked in an inheritance battle, primarily with his third wife Priya Kapur, over the personal assets of the former Sona Comstar chairman, claiming their share as Class-1 or immediate heirs.
Among the late businessman’s personal assets, which are a part of the inheritance dispute, are an apartment in New York and another immovable asset in London. Additionally, there is Sunjay’s demat and bank accounts, artworks and crypto investments, apart from residuary estate, which also form part of his personal assets.
Senior advocate Mahesh Jethmalani appeared on behalf of Karisma Kapoor’s children as the hearing over the contents of the will, which they have termed as “bogus”, entered the second day. He submitted at the High Court, “This is a case where almost every circumstance which the Supreme Court has considered to be a suspicious circumstance, is present. It is not just a will shrouded in suspicious circumstances…(but also) no lawyer to draft the will. A layman witness, very obliged, and actually rewarded by being made a director of the holding company of this vast estate.”
Apart from highlighting discrepancies in formatting, Jethmalani also pointed out that the will misspelt the name of the late businessman’s six-year-old son, Azarias, with Priya who he was living with. It recorded the residential addresses of Samaira and Kiaan at Karisma’s office address instead, he claimed.
“He misspells his 6-year-old son who used to stay with him…This (misspelt name) is at five places in the will; gets the address wrong for his two children with Karisma…This is not the address, Sunjay used to live with Karisma Kapoor, he has visited that house frequently…This is an office address of Karisma, partly a residential property…and Mr Sunjay Kapur knew that…Then Safira (Priya’s daughter from her previous marriage with hotelier Vikram Chatwal) Chatwal (too has been named in the will)…she was not formally adopted (by Sunjay), in fact she has a living father (Vikram) who she shares a very good relationship with…Note, he doesn’t call her (Safira) daughter (in the will)…These are bloopers that Sunjay Kapur would have never made…these kind of mistakes are totally uncharacteristic…This will has been ex-facie cast in the dustbins of history, it demeans him, that he will execute a will like this (full of errors),” Jethmalani said.
“’I’ve the following three bank accounts, says he (Sunjay), allegedly, which ‘consists of my own funds, life savings and gifts received from friends and relations on several occasions’. But the three bank accounts have become six in the table below…so he says three (in the text of the will) and then with a magic wand it becomes six… It’s a clear glaring blunder in the will,” Jethmalani further pointed out.
