A Motor Accident Claims Tribunal (MACT) in Delhi last Thursday awarded Rs 32.93 lakh compensation to the family of a 23-year-old man who was killed in a road accident in 2023.
“It is thus held that the accident happened due to rash and negligent driving of the driver of the offending vehicle (truck)…It said that it was proved that no negligence could be attributed to the deceased in exercising due diligence for averting the accident,” said Presiding Officer Shelly Arora in her order dated October 30.
She was hearing a petition filed by the family of Krishan Gopal, the victim who was hit by a speeding truck while riding his bike near Sarita Vihar Metro station in August 2023. MACT awards Rs 32 lakh to kin of man died in road accident in 2023
While granting the compensation, the Tribunal looked at various factors such as loss of dependency, a multiplier, grant of loss of estate, loss of consortium and funeral expenses.
“Thus the total award amount comes to Rs.31,60,530/- (+) Rs 18,150/-( Loss to estate) + Rs. 18,150/-( funeral expenses) +Rs.96,800/- (loss of consortium) = Rs.32,93,630/-,” the MACT noted.
Noting that the speeding truck was insured by The New India Assurance Co Ltd at the time of accident, the MACT also directed it to deposit the amount.
