Poetry over property: Delhi judge recites his poem while granting bail to man in property dispute case

A judge of a Delhi Court Friday recited a poem in his order granting bail to a man accused of illegally possessing his mother’s property in the national capital. Judicial Magistrate First Class Rohit Kumar of Rohini Court recited his poem Jang-e-Milkiyat.

The court order began with the judge’s poem, “Milkiyat ki jang mein na jaane kitne afsaane hue, kuch hi apne the, vo bhi ab begaane hue. Banke Krishna, ab kisi ko aana hoga, sadte, ladte, bigadte rishhton ko bachaana hoga. Na jaane ye jang aur kitne Mahabharat laayegi, aakhir kitno ko salaakhon tak le jaayegi. Bankar beti, rishto ko bachaana hoga, sabhi naato ko nibhana hoga. Kya rakha hai is jang mein koi bataayega, aakhir is dharti se kaun kya hi le jaayega“.

Loosely translated, it means, “I don’t know how many tales were created in the war for property, some were ours, now even those have become strangers. Someone will have to become Krishna, and save the rotting, fighting, deteriorating relationships. I don’t know how many more Mahabharats this war will bring, ultimately, how many will be taken to prisons. As a daughter, we will have to save relationships, fulfil the bond of kinship. Can anyone tell me what’s going on in this war? After all, who will take what from this earth?”

In this case, Indu Soni lodged a complaint against her son, Nitin Soni, and his wife, Taruna. She alleged that her son and daughter-in-law had taken possession of her house in Delhi illegally by breaking the lock. She also stated before the court that Taruna had beaten her with a rod when she tried to enter her house.

Nitin, on the other hand, argued before the court that his mother had hatched a conspiracy to “snatch” the property from him, and it had been handed over to him by her. He said he was the “real owner” of the property, and that he was being tortured by his mother in connivance with police officers.

He also claimed that there was CCTV footage dated July 14, where his sister can be seen entering the disputed property with goons who have rods in their hands.

“After conclusion of the arguments, on the specific query of the court, it has been submitted by the IO that till now no CCTV footage or video is recovered which could reflect that accused persons had broken the lock of the property and entered into the property on 10.07.2025 or before,” said JMFC Kumar in his order granting bail to Nitin.

“There is no evidence at this stage to show that the accused Nitin Soni had broken the lock of the property, and entered the house of the complainant forcefully. There is no evidence to show that the accused instigated his wife to attack the complainant with a rod,” the court added.
